Caffè Borbone (Z.I. Località ASI Pascarola 80023 – Caivano (Naples, Italy)) complies with the legal guarantee obligations established by consumer law with regard to all of its products, including coffee and coffee machines:

  1. coffee products are guaranteed against product defects up until their expiry date;  
  2. coffee machines are guaranteed against defects for a period of 2 years after purchase.

In the event of defective products, Caffè Borbone will repair or replace the defective product. If these primary remedies are not practicable, the Customer may request the termination of the contract or the proportional reduction of the purchase price.

No guarantee applies if the defect is caused by improper use or fault on the part of the customer.

Right of withdrawal

Consumers have the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires 14 days from the day on which the consumer or a third party indicated by the consumer (other than the carrier) acquires physical possession of the goods or, in the case of the regular delivery of the purchased goods, from the day on which they acquire physical possession of the first good.

In order to exercise the right of withdrawal, the consumer must inform the professional (Caffè Borbone S.r.l. – Z.I. Località ASI Pascarola 80023 – Caivano (Naples, Italy)) of their decision to withdraw from the contract by means of an explicit declaration. The consumer may also communicate their decision to withdraw electronically by following the instructions in the following section “Instructions for exercising the right of withdrawal”, in which case the consumer will receive email confirmation of receipt of the withdrawal request without undue delay. In order to comply with the term for withdrawal, it is sufficient to send the notice communicating the exercise of the withdrawal right prior to the expiry of the withdrawal period.

Effects of withdrawal

In the event of withdrawal, the trader shall reimburse all payments received from the consumer, including the costs of delivery (with the exception of any additional costs resulting from their choice of a delivery service other than the least expensive standard delivery service offered by the trader) without undue delay and in any event not later than 14 days from the day on which the trader is informed of the consumer’s decision to withdraw from the contract. Such reimbursements will be made using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed otherwise. In the event of cash on delivery payment to the carrier, reimbursements shall be made by bank transfer using the bank details communicated by the consumer to the trader. In any event, the consumer shall not incur any fees as a result of such reimbursement.

The consumer is requested to return the goods using the return label provided by the trader and following the shipping instructions provided upon receipt of the notice of withdrawal without undue delay and in any event within 14 days of the day on which the consumer communicated their withdrawal from the contract. The term is respected if the consumer returns the goods before the expiry of the 14-day period. The costs of returning the goods shall be borne by the trader unless otherwise stated in the contract. The consumer shall only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
